GIVEAWAY RULES
- This competition is not open to residents of the ACT.
By submitting an entry to this competition (“Giveaway”), you acknowledge that you have read and agree to be bound by these rules (“Rules”) and the decisions of Cluey Ltd (“Promoter”), and that you satisfy all eligibility requirements.
The Giveaway is only open to residents of Australia who are 16 years or older at time of entry. Employees of the Promoter, its respective parent, subsidiaries, affiliates, advertising and promotion agencies, distributors, merchants involved with the Giveaway, and their immediate family members and/or those living in the same household of each are not eligible to enter or win. The Giveaway is governed by Australian law and is subject to all applicable federal, state and local laws and regulations. No purchase necessary to enter or win. A purchase will not improve your chances of winning.
All entries to the Giveaway become the property of the Promoter. The Promoter collects personal information from entrants to conduct the Giveaway and may, in the course of business, disclose the personal information to third parties, as required. Entry in this Giveway is conditional on provision of the personal information requested. Entries may be entered into a database and the Promoter may use the entrants' names and addresses for future promotions, marketing and publicity in various forms by the Promoter, and the entrant consents to such use.
HOW TO ENTER:
To enter the Giveaway, follow all onscreen instructions to complete and submit the online entry form ("Primary Entry"). All entries must be received between 12:01AM AEDT on 04/05/2023 and 11:59PM AEDT on 30/06/2023 ("Giveaway Entry Period"). Online entrants are subject to all notices posted online including but not limited to the Promoter's privacy policy.
PRIZES & APPROXIMATE RETAIL VALUES ("ARV"):
Maximum ARV of all prizes: $3,700.
The competition winner will receive an individual prize of:
- 40 weekly tutoring sessions with Cluey Learning for a Year 2-12 student in one subject (Maths or English for Years 2-12, or Biology, Chemistry or Physics for Years 11-12).
- A choice of either private 1-to-1 or small group format depending on year level.
- Tutoring sessions will not take place during school holidays or public holidays and will expire within one year of the prize being awarded. Any cancelled sessions will not be rescheduled.
ODDS:
Odds of winning depend on the number of eligible entries received during the Giveaway Entry Period.
THE FOLLOWING APPLIES TO THE ABOVE:
The competition winner will be determined on or about the 05/07/2023 at 10:00AM AEDT by a representative from the Promoter (“Judge”) whose decisions are final. The draw will take place at the Promoter’s corporate office found at L2 / 117 Clarence Street Sydney NSW 2000.
The winner will be notified by email and/or mail and, at the Judges' discretion, will be required to complete and return an email confirmation of prize acceptance and possibly an Affidavit of Eligibility, and Liability and a Publicity Release ("Affidavit/Release") within 7 days of notification, or an alternate winner will be selected.
If any potential winner cannot be contacted within 90 days of the initial draw date, or if an Affidavit/Release is returned as undeliverable, or if the selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Rules, the prize will be forfeited.
If a winner is otherwise eligible under these Rules but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner's parent or legal guardian who will be required to execute an Affidavit/Release on the minor's behalf.
No substitutions are permitted except if the prize is unavailable, in which case a prize of equal or greater value will be awarded. The prize is not redeemable for cash and non-assignable and non-transferable.
The prize must be fully consumed by no later than 31/12/2024. Any portion of the prize that is not consumed by this date will automatically be forfeited.
Any other incidental expenses related to the prize not specified herein are the sole responsibility of the winner.
The prize winner agrees to share images and testimonials of their experience with the Promoter over the course of their learning to be posted online for promotional purposes.
It is not the Promoter’s responsibility to ensure the prize winner has a computer and internet connection capable of conducting the learning. This is the sole responsibility of the prize winner.
Participating entrants agree to these Rules and the decisions of the Promoter, and release, defend and hold harmless the Promoter and its affiliated companies, and all other businesses involved in this Giveaway, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation, acceptance and use or misuse of the prize. The winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Giveaway or use or redemption of the prize. The Promoter is not responsible for any typographical or other error in the printing of the offer, administration of the Giveaway or in the announcement of the prize.
The winner acknowledges the Promoter and all other businesses concerned with this Giveaway and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the prize.
The Promoter is not responsible for: (i) lost, late, misdirected, damaged, illegible or incomplete entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorised access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Promoter on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to the entrant's or any other person's computer related to or resulting from participating in the Giveaway.
By participating in the Giveaway, you (i) agree to be bound by these Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Promoter, which are final and binding in all matters relating to the Giveaway.
The Promoter reserves the right to permanently disqualify persons it believes has intentionally violated these Rules and cancel the Giveaway if it becomes technically corrupted (including if a computer virus, bot or system malfunction inalterably impairs its ability to conduct the Giveaway), and to select the winner from among all eligible entries received prior to withdrawal.
ARBITRATION:
This Giveaway shall be governed by and interpreted under the laws of the State of NSW, Australia. By participating, entrants agree that any and all disputes arising out of or relating in any way to this Giveaway shall be litigated only in courts sitting in Sydney, NSW, Australia.
